P&L Models LTD – Terms and Conditions of Supply

By placing an order with P&L Models LTD (“we”, “us”, or “our”), you agree to be bound by the terms outlined below. Different provisions may apply to trade and consumer customers as indicated.

1.Pro Forma Basis & Credit Accounts (Trade Customers Only)

All trade sales are conducted on a pro forma basis unless a credit account is agreed in writing. Credit accounts are available by application and subject to credit checks and approval. Please contact us to apply.

2.Prices Prices are quoted in GBP.

For trade customers, prices are exclusive of VAT.

For consumer customers, VAT is included where applicable.

We reserve the right to change prices at any time without prior notice.

3.Delivery

We aim to meet delivery estimates but cannot guarantee exact dates. Orders may arrive in more than one delivery.

For trade customers: Claims for damaged or missing items must be made within 7 working days of receipt. Non-delivery must be reported within 3 days of the invoice date. 

For consumers: You have 14 days from receipt to report any issues with your order.

4.Payment Terms Trade customers:

Pro forma invoices must be paid in full prior to despatch. Credit account holders must settle invoices within 28 days of the invoice date. We reserve the right to charge interest on overdue payments under the Late Payment of Commercial Debts (Interest) Act 1998. Goods remain our property until paid in full.

Consumers: Payment must be made in full at checkout. Goods remain our property until full payment is received.

5.Risk and Title

Risk passes to you upon delivery. Ownership of goods remains with us until all outstanding amounts are paid in full.

6.Export Orders (Trade Only)

It is your responsibility to ensure goods comply with import and sales regulations in the destination country. We are not liable for customs issues or rejected goods. 

7.Product Descriptions and Variations

We strive to ensure all product details, descriptions, and images are accurate. However, products may vary slightly in colour, specification, or packaging. We will inform you of significant changes where possible.

8.Product Recall

If we initiate a product recall, you must immediately stop selling the affected items and assist us as needed. We will reimburse reasonable recall costs unless caused by unauthorised modifications or misuse.

9.Catalogue Validity (Trade Only)

Printed catalogues are valid for the period indicated. We reserve the right to amend prices and shipping costs even within this period if necessary.

10.Consumer Rights (Retail Customers)

If you are a consumer, you have rights under the Consumer Contracts Regulations 2013: You may cancel your order within 14 days of receiving your goods. Goods must be returned unused and in original condition. Refunds will be issued within 14 days of receiving returned goods. Return postage is your responsibility unless goods are faulty. This does not affect your statutory rights.

11.Liability

We are not liable for any indirect or consequential loss, including loss of profits. Our total liability shall not exceed the value of the goods supplied. We do not exclude liability for death or personal injury caused by negligence, fraud, or for rights under the Sale of Goods Act 1979 or Consumer Protection Act 1987.

12.Force Majeure

We are not liable for delays or failures caused by events beyond our control, including but not limited to natural disasters, strikes, or transport disruptions.

13.Governing Law and Jurisdiction 

These terms are governed by English law. Any disputes shall be subject to the exclusive jurisdiction of the English courts.
